Anambra Businessman Sues Police Officer For Alleged Unlawful Arrest, Detention

An Awka based businessman, Tochukwu Nwokoye Nwosu, has dragged a senior police officer, CSP Ifeanyi Iburu, to court, alleging unlawful arrest and detention in Anambra.

Nwosu, also demanded that CSP Ifeanyi Iburu, pay the sum of N20million to him as compensation for the violation of his fundamental rights to personal liberty.

In a suit filed through his counsel, Joe O, Eze and Associates, at the High Court Awka, in Anambra state, Nwosu (the Applicant), alleged that his arrest and detention were a clear breach of his fundamental rights, as enshrined in the Nigerian Constitution.

He further alleged that the respondent, CSP Ifeanyi Iburu, abused his powers, violating his rights without any lawful justification.

He therefore prayed the court to declare his arrest and detention as unlawful, and that CSP Ifeanyi Iburu pay him N20million as compensation for the damages suffered.

Joe O, Eze, alleged that his client (Nwosu), was arrested on September 4, 2024, at Kamali Phase III, behind Dubai Estate, Awka, by 10 am without any justifiable reason.

According to him, his client was subsequently detained inside the cell of the Police Rapid Response Squad, Awkuzu, from 10 am to 10 pm, further infringing on his rights.

He noted that this case highlights concerns about police brutality and the need for law enforcement agencies to respect citizens’ fundamental rights.

He added that the outcome of this case will have significant implications for the protection of citizens’ rights and the accountability of law enforcement agencies in Anambra State.
